This Consumer Testimonial and Media Consent Agreement (the “Agreement”) is entered into by and between Nationwide Mortgage Bankers, Inc., NMLS #819382 (“NMB”), and the individual providing consent by wet signature, electronic signature, or submission via web form (“Consumer”).

Authorization to Use Testimonial and Media Content

By agreeing to these terms, Consumer grants NMB permission to use their name, image, likeness, voice, statements, audio or video recordings, photographs, and any general footage or images captured in connection with a loan closing or testimonial for lawful business and promotional purposes. These purposes may include, but are not limited to:

• Social media content
• Website content
• Marketing and advertising materials
• Internal communications
• Company announcements

Voluntary Participation and No Impact on Loan Terms

Consumer understands and agrees that participation is completely voluntary and is not a condition of receiving any loan, product, or service from NMB. Participation, or refusal to participate, will not affect loan approval, loan terms, interest rates, or access to any NMB product or service.

No Compensation and No Endorsement

Consumer acknowledges that they will not receive compensation of any kind for participation. Consumer further understands that their name, likeness, or statements will not be presented as a paid endorsement of NMB loan products or services.

Privacy and Limitation on Use of Information

NMB agrees not to publish or disclose any non public or private consumer information unless such information is knowingly and voluntarily provided by the Consumer as part of the testimonial. NMB will exercise reasonable discretion and respect Consumer privacy rights in all uses of testimonial materials.

Representation of Authority and Accuracy

Consumer represents and warrants that they have the authority to grant this consent and release and that any statements provided are accurate to the best of their knowledge.

Release and Waiver

Consumer hereby releases and holds harmless NMB from any and all claims, demands, or causes of action, including rights of privacy, publicity, defamation, or other legal or equitable claims, arising out of or related to the authorized use of testimonial and media content, provided NMB complies with its obligation not to disclose non public information.

Right to Revoke Consent

Consumer may revoke this authorization at any time by submitting written notice to compliance@nmbnow.com.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

Entire Agreement and Modification

This Agreement constitutes the entire understanding between the parties relating to the subject matter herein and supersedes all prior agreements or understandings. This Agreement may not be altered or amended except in writing signed by both parties.
