Consumer Testimonial Consent Agreement
This Consumer Testimonial Consent and Release Form (the “Agreement”) is entered into by and between Nationwide Mortgage Bankers, Inc, NMLS# 819382 (“NMB”), and any individual who agrees to these terms by way of wet or electronic signature or by web form (“Consumer”).
Authorization to Use Testimonial Material:
By signing this Agreement, Consumer hereby grants NMB permission to use their image, statements, name, audio/video testimony, and any general footage/pictures from the closing for marketing and promotional purposes.
Limitation on Use of Private Information:
NMB agrees not to publish any non-public or private information about Consumer unless explicitly provided by the Consumer in their testimonial. NMB shall exercise discretion and respect Consumer’s privacy rights.
Representation of Authority:
Consumer represents and warrants that they have the authority to grant this consent and release, and that the information provided in the testimonial is accurate to the best of their knowledge.
Release and Waiver:
Consumer releases NMB from any rights or claims they may have, including but not limited to rights of privacy subject to NMB complying with its representations not to publish non-public information, publicity, defamation, or any other legal or equitable claims, arising out of or in connection with the use of the specified information for prospective NMB consumers to review and/or as marketing material for NMB.
No Compensation:
Consumer acknowledges that they are providing their testimonial voluntarily and without expectation of compensation.
No Alteration of Agreement:
This Agreement cannot be altered, amended, or modified in any way unless done so in writing and signed by both parties.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of law principles.
Entire Agreement:
This Agreement contains the entire understanding of the parties and supersedes all prior agreements and understandings, whether oral or written, relating to the subject matter hereof.
